An 11-year-old boy died after a toy train overturned at Elante Mall, Chandigarh, FIR was registered alleging negligence and misconduct

In a tragic incident that took place at Elante Mall, Chandigarh, Punjab, an 11-year-old boy Shahbaz, from Nawanshahr, died after a toy train overturned. The incident occurred on Saturday night when the child was riding on the toy train. He fell from the toy train and was rushed to the nearby hospital, GMCH-32 (Government Medical College Hospital) but sadly passed away due to severe head injuries. On Sunday (June 23) morning around 4 a.m., the child’s body was handed to the parents. 

The incident was captured on a CCTV camera installed in that area and the same was reported on June 22. The video was posted on X (formerly known as Twitter) by Gagandeep Singh. The post said, “CCTV visuals of a tragic incident at Chandigarh’s Elante Mall, where a toy train overturned, leading to the death of an 11-year-old boy named Shahbaz from Nawanshahr. In the video, it can be seen that Shahbaz was leaning out of the toy train window when it suddenly overturned as the driver made a turn. The police have seized the toy train and registered a case against the operator.” 

The police have taken the toy train in possession and a case has been registered against the driver of the toy train and mall management under different Sections of the Indian Penal Code (IPC) on the statement of deceased’s parents alleging negligence and misconduct. Father of the deceased, Jatinder Pal Singh, in his complaint, blamed the operator and the company for ensuring the safety of the passengers riding the toy train which resulted in the tragic loss of his son. While stating to the media, the police official said that the case has been registered under Section 304(A) of the IPC and an investigation has been initiated into the matter. 

Section 304(A) of the IPC deals with ‘Causing death by negligence’. It states that “Whoever causes the death of any person by doing any rash or negligent act not amounting to culpable homicide, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.”
