Kapil Sibal's 'lost hope in Supreme Court' remarks 'contemptuous', says law fraternity

Senior Advocate and Member of Parliament Kapil Sibal 's reported remarks against the Supreme Court evoked a pointy response from the legal fraternity and also the All India Bar Association (AIBA) said that the Samajwadi Party (SP) leader's remarks were 'contemptuous'. Expressing displeasure over a number of the recent judgments, Sibal , on Monday said that he had lost hope within the Indian judiciary.

MK Mishra, Chairman, Bar Council of India said that blaming the judicatory after losing some cases is 'not proper'. "I don't think such an announcement are often appreciated by anyone," he said. Adish Aggarwala, Chairman, AIBA said that the statement made by Sibal is contemptuous. "Court decides cases by applying facts presented before them, they hold allegiance to the constitution of India," he said.

While underlining that Sibal is an integral a part of the justice dispensation system, Aggarwala added that if he actually feels a loss of hope within the institution, then Sibal is free to not appear before the courts. Senior Advocate and Rajya Sabha MP Mahesh Jethmalani said that one should hold the institution in high esteem, as 'that could be a duty being a lawyer and a parliamentarian'.

Earlier today, Sibal stirred a row by saying that he has no hopes from the Indian judiciary. "This year i will be able to complete 50 years of practising within the Supreme Court and after 50 years I feel i've got no hopes from the institution. You discuss progressive judgements delivered by the Supreme Court but there's huge difference of what happens at the bottom level. Supreme Court gave judgement on privacy and ED officers come to your home... Where is your privacy?" said Sibal.
