Pinnacle court begins hearing ex-Servicemen' case regarding One Rank One Pension'

The Top Court today started hearing the case demanding execution of One Rank One Pension in the armed forces of India.

This matter was now listed in front the bench of Justices DY Chandrachud, Surya Kant and Vikram Nath. This case was filed by the ex servicemen union of India In Spite of parliament on floor made a promise and delivered that what is being executed is "different pensions for the same rank depending on when the person retired".

The interrogations were raised by the petitioners earlier dated on 7thNovember, 2015, mentioned by the Central government wherein while implementing OROP, it had considered varied meanings of the context under this there’s strong empty space in the both pension rates present and in the past.

Senior counsel noted that "Notification uses "periodic" & further elements of inequality. That renders it arbitrary on the face of it".

Senior Counsel continued and mentioned a speech earlier dated on 26th February 2014 by the Minister of Defense. Senior counsel also submitted that "You can't introduce the devil in the details. Now you're putting riders".

In the time arguments of hearing, additional solicitor general mentioned allocations of budget to inform the bench.

The Apex court questioned the union government that they can include automatic annual revision beside the present policy of periodic review one time in 5 years.

Finally today after hearing so many issues and arguments the top court ordered the union government to make sure one rank, one pension promise.
