Pinnacle court takes up union vs state case regarding control of bureaucrats in national capital

Issue has been raised in the national capital that who should control the bureaucrats in the respective area

This case sets the central vs state government in the national capital and goes to hearing in the apex court on 3rd March.

Senior advocate Abhishek Manu Singhvi mentioned this case in front of the CJI NV Ramana in support of the Government of Delhi and seeked a hearing.

Present issue has been a legal conflict between the government in the union and the government of Delhi regarding the power authority on key bureaucratic matters.

Manu Singhvi strongly mentioned that said case keeps an main query of law observance with administration and governance in the capital.

Main issue of dispute is the matters regarding the transfer proceedings of IAS (Indian Administrative Service) officers.

Early in the year of 2018, the supreme constitutional bench comprising five judges ordered that the  LG who is the Union government's mouth voice in the national capital didn’t have powers to take own decisions and the real executive which got elected government has powers to take own decisions except issues related to police, law and order and land.

After that in 2019, Apex Court’s two judge bench delivered a divided judgement so they referred the case to a supreme court’s bench consisting of three judges.

Finally, today a bench headed by Chief Justice and comprising Justices AS Bopanna and Hima Kohli agreed to hear this matter on 3rd March.

At present there’s a narrow jurisdiction of the powers in national capital LG of Delhi looks at matters to land, police and public order and related to all other matters, the LG should act upon the aid and advice of the council of ministers.
