In the Supreme Court (SC) of India, an application had been filed seeking to direct the Union Government to restore the statehood of Jammu & Kashmir within a time-bound period. The application was filed by college teacher Zahoor Ahmed Bhat and activist Khurshaid Ahmad Malik contending that the failure to restore the same violated the basic feature of federalism. The applicants said, βThe non-restoration of the status of Statehood of Jammu and Kashmir in a time-bound manner violates the idea of federalism which forms a part of the basic structure of the Constitution of India.β They added that despite the assurance given by Solicitor General Tushar Mehta that the statehood would be restored as soon as possible, the Union government has not taken any step since the top court delivered its judgment in the Article 370 case. The application also stated that β....there is no impediment of security concerns, violence or any other disturbances which would hinder or prevent the grant/restoration of the status of Statehood to Jammu and Kashmir as had been assured by the Union of India in the present proceedings,β as the Assembly elections were held peacefully showing no impediment in restoring statehood.
