Today, the bench comprising Justices PV Sanjay and Dinesh Maheshwari was hearing a petition filed against the defamation case filed by Tamil actor Maha Ghandhi seeking to quash the criminal defamation. The petition was filed by another Tamil actor, Vijay Sethupathi, who was accused of attacking Ghandhi along with his manager. The Supreme Court urged Tamil actors to settle the defamation case as well as referred the matter to mediation.
During the hearing of the case, Sethupathi’s lawyer stated that all other charges except Section 500 IPC were quashed by the Madras High Court. The Counsel further highlighted that the comments were made in good faith to the actor’s interest under Section 499 IPC. Further, Justice Maheshwari said that “You are a theatre person, your voice matters, it imprints on the public. If you are an actor with a wide following, then you are supposed to be more disciplined. As a responsible person, you are not supposed to call names.”
In addition, the bench noticed that the matter was capable of compromise stating that “There is some fault on both parties side. Both of you are not free from blemish completely. But try to work out a settlement.” Moreover, the top Court asked them to appear at the mediation Centre of the Supreme Court on March 2, 2023. Concluding the case, the judges said “Settle and you can play Holi together.
