Recently, the Supreme Court (SC) vacation bench of Justice Ahsanuddin Amanullah and Justice Sudhanshu Dhulia agreed to hear the case regarding the validity of the Chhatisgarh High Court judgment that set aside appointments of B.Ed degree holders as Assistant Teachers at primary schools. The bench was hearing the challenge to the Chhatisgarh HC’s judgment that subsequently resulted in quashing the appointments of B.Ed degree holders as Assistant Teachers at primary schools. Noting that the matter would require a detailed hearing, the SC bench adjourned it to August 2024. While considering the matter, the SC opined that the fundamental right of primary education in India not only includes free and compulsory education for children below the age of 14 years but also includes the quality of the education provided to them. It added that the B.Ed degree holders would not be able to provide quality education to primary school children because they did not pass the basic pedagogical threshold which is mandatory for teaching primary classes.
