On July 24, 2024, the Supreme Court (SC) Collegium constituting Chief Justice of India DY Chandrachud, Justice Manoj Misra, and Justice JB Pardiwala passed a resolution recommending an extension of tenure by 1 year for nine additional judges of the Calcutta High Court (HC). The names of Additional Judges recommended for extension of tenure are as follows:
Earlier on April 29, 2024, the Calcutta High Court Collegium unanimously recommended the aforementioned Additional Judges for appointment as permanent Judges of that High Court. The SC Collegium refuses to make nine Additional Judges of the Calcutta HC permanent but recommends a fresh 1-year term. While recommending the names, the Collegium in its resolution said, “A Committee of two Judges of the Supreme Court constituted by the Chief Justice of India in terms of the Resolution dated 26 October 2017 of the Supreme Court Collegium has assessed the judgments of the above Additional Judges. With a view to assess the merit and suitability of the above-named Additional Judges for their appointment as permanent Judges, the Collegium has scrutinized and evaluated the material placed on record.”
After considering all aspects of the matter and on an overall consideration of the HC’s proposal, the Collegium pointed out that the Additional Judges of the Calcutta High Court, as mentioned before, deserve to be appointed as Additional Judges for a fresh term of one year. The resolution reads, “In view of the above, the Collegium resolves to recommend that S/Shri Justices (i) Biswaroop Chowdhury, (ii) Partha Sarathi Sen, (iii) Prasenjit Biswas, (iv) Uday Kumar, (v) Ajay Kumar Gupta, (vi) Supratim Bhattacharya, (vii) Partha Sarathi Chatterjee, (viii) Apurba Sinha Ray, and (ix) Md. Shabbar Rashidi, Additional Judges, be appointed as Additional Judges of the High Court at Calcutta for a fresh term of one year with effect from 31 August 2024.”
