While hearing Aam Aadmi Party (AAP) leader, Shelly Oberoi’s plea regarding the Municipal Corporation of Delhi (MCD) election, the Supreme Court observed that “Nominated members cannot go for election. The Constitutional provision is very clear.” In this context, Senior Advocate appearing for the petitioner, Advocate Dr. Abhishek Manu Singhvi said that Constitution makes it very clear under Article 243R.
The case was heard by Chief Justice of India DY Chandrachud, Justice JB Pardiwala, and Justice PS Narasimha. Additional Solicitor General Sanjay Jain, representing Delhi Lieutenant Governor VK Saxena stated that there were some arguments on this.

After three failed attempts to conduct MCD Mayor, Deputy Mayor, and standing committee election, the Delhi Municipal Corporation councilors will meet again on Thursday, February 16, 2023. Due to paucity of time, the top Court bench was not able to hear the matter in detail today; therefore, the bench along with ASG agreed to take it to February 16. Moreover, Delhi Lieutenant Governor agreed to conduct the MCD election on the date proposed by the Delhi Government, February 16.
