Indian National Congress, Shiv Sena, and Aam Aadmi Party, along with other 11 political parties moved to the Supreme Court against the alleged arbitrary use of Central agencies such as the Central Bureau of Investigation (CBI) and Enforcement Directorate (ED) in arresting leaders of opposition parties. Today, Senior Advocate AM Singhvi mentioned the matter on behalf of 14 political parties before Chief Justice of India DY Chandrachud, seeking guidelines for courts and law enforcement agencies on arrest, remand, and bail. CJI listed the matter for hearing on April 5, 2023.
Senior Advocate submitted that “95% of cases are of opposition leaders. We’re asking for pre-arrest guidelines and post-arrest guidelines.” The other political parties involved include Bharat Rashtra Samithi, Janata Dal (United), Jharkhand Mukti Morcha, Communist Party of India, Communist Party of India (Marxist), J&K National Conference, Samajwadi Party, Dravida Munnetra Kazahgam, Rashtriya Janata Dal, All India Trinamool Congress, and NCP (National Congress Party).
