The Top Court told election commission not to issue any bypoll order till 10th November in Azam Khan Disqualification case

The Apex Court today noted to the ECI not to release notification till 10th November.

The order for the general election poll at Rampur Sadar in the state of UP, from so many days that seat is vacant after the disqualification of SP legislator Azam Khan just after he got convicted in the hate speech case.

SC bench led by CJI D Y Chandrachud noted a special sessions court to look into the matter and take steps by tomorrow the challenge of Azam Khan requesting a stay on his hate speech conviction so that he can’t get disqualification as a MLA in state of UP.

The top court noted that the EC can order the notification for the further poll on or further 11th November; once the local district court takes the judgement on Khan's case. 

28th October, the UP State Legislative Assembly Secretariat declared the disqualification of  Azhar Khan from the assembly.

27th October, Azhar Khan got convicted in the case of hate speech and went to 3 years in jail by a Rampur Sessions court.

The sessions court which delays cases of MP-MLA in Rampur also gave bail to Azam Khan in the case of 2019.
