This month, the Supreme Court (SC) of India passed approximately 95 Judgments including around 20 Non-Reportable Judgments. Moreover, the SC heard matters relating to bail, arrest by the ED, irretrievable breakdown of marriage, stray dog menace, and many more. This month was busy as the top court experienced summer vacation that started on May 20, 2024. Let us explore the judgments pronounced by the SC in May 2024.
Judgment Name: Abhimeet Sinha & Ors. vs. High Court of Judicature at Patna & Ors. (May 06, 2024)
Bench: Justice Hrishikesh Roy and Justice Prashant Kumar Mishra
Brief: The SC upheld the minimum qualifying marks requirement in the interviews/ viva voce test as a part of the Selection criteria for appointment to the District Judiciary in the states of Bihar and Gujarat. It said, “An interview unveils the essence of a candidate— their personality, passion, and potential. While the written exam measures knowledge, the interview reveals character and capability. Therefore, a person seeking a responsible position particularly as a judicial officer should not be shortlisted only by their performance on paper, but also by their ability to articulate and engage which will demonstrate their suitability for the role of a presiding officer in a court.”
Judgment Name: BAR of Indian Lawyers through its President vs. D.K. Gandhi PS National Institute of Communicable Diseases and anr. (May 14, 2024)
Bench: Justice Bela M Trivedi and Justice Pankaj Mithal
Brief: The SC held that advocates are not liable under the Consumer Protection Act, 1986 for deficiency of service stating that the legal profession is sui generis and cannot be compared with any other profession.
The SC pronounced only 1 Judgment in June 2024 as the Court was experiencing summer break.
