“Heroin finishes everything:” Bail may be granted in NDPS cases where ganja or charas is involved but not for heroin, says Supreme Court

Recently, the Supreme Court (SC) bench constituting Justice CT Ravikumar and Justice Sanjay Karol was hearing the bail application of an accused (61-year-old woman) for carrying 500 grams of heroin. The bench remarked that while it may grant bail in NDPS (Narcotics Drugs and Psychotropic Substances Act) cases where ganja or charas are involved, it may not do the same for heroin cases. The bench said, “You must understand that in cases where charas and ganja are involved, we have always shown our indulgence when bail is sought, but in the case of heroin, we have to be tough." 

Earlier, after noting that the accused was traveling in the same car in which the heroin was found, the Punjab & Haryana High Court refused to grant her bail. The matter was therefore mentioned before the top Court by the counsel appearing for the accused on the account of the woman’s age. Justice Ravikumar said that the woman was alleged to have been found with heroin (500 grams). Further, Justice Karol said, “Heroin finishes everything. It wipes away the younger generation completely. We cannot interfere right now.”
