Supreme Court rejected the petition filed by Manish Sisodia

On 28th February 2023, the Supreme Court rejected the petition filed by Manish Sisodia challenging the arrest by CBI in a corruption case related to the now-scrapped excise policy and asked him to move to the High Court. Deputy Chief Minister of Delhi, Manish Sisodia approached the Supreme Court seeking bail against his arrest. The case was presented before the Chief Justice of India DY Chandrachud and Justice PS Narasimha who said that “You are challenging an FIR, challenging remand, seeking bail, all under Article 32. You have remedies before the High Court under Section 482 CRPC.”
During the hearing, Advocate Dr. Abhishek Manu Singhvi, appearing for Manish Sisodia, referred to the cases of Vinod Dua and Arnab Goswami where Article 32 was invoked for bail. Also, he highlighted the verdict delivered in the Jagisha Arora case in which bail was allowed to the journalist in a writ petition filed against a remand order. The top Court further asked the Advocate why the arguments could not be presented before the Delhi High Court. Which, Advocate Singhvi stated that the Delhi HC judge was not holding sittings on most days because of his involvement in the PFI case. Further, the top Court ordered to move the matter to the High Court.
