Supreme Court seeks govt response on including same-sex marriage under Special Marriage Act

The Top Court today noted that it is going to consider the plea’s related to considering lawful recognition to same sex marriages and issued notice for response from union in regarding the same.

This present notice was based on two pleas by gay pairs requesting guidelines that their wedding to be recognised as per the special marriage law.

Bench composed of Justices CJI Chandrachud and Hima Kohli listened to the plea submissions of senior lawyer Mukul Rohatgi before issuing the notices on the pleas. 

The court asked for the reaction from the union government in this case and ordered the union to file a response within one month.

The apex court has asked the AG of India to assist the court.

The decision by the Pinnacle Court to allow the case comes after a fresh plea was has been filed before it by a gay pair from Hyderabad, requesting the recognition of same-sex marriage under the Special Marriage Act, 1954.
