The Pinnacle Court allows Unnao rape survivor's plea to transfer case from UP to Delhi

The Supreme Court on Friday allowed a plea filed by the survivor of the 2017 Unnao gang rape case, seeking transfer of a case lodged against her from Uttar Pradesh to Delhi. The case will now be heard at Delhi's Saket court.

In her plea, the survivor has stated that she was being harassed by frivolous cases filed against her by the in Unnao while she was recording her statement in a very Delhi court. She also said that thanks to her non-appearance within the said cases, a neighborhood court had issued non-bailable warrants against her.

A local court in Unnao had issued a non-bailable warrant against the survivor on a criminal complaint of alleged cheating and forgery filed by the daddy of 1 of the accused being tried within the rape case.

Last week, the Supreme Court took notice of the survivor's plea and asked the Uttar Pradesh government to retort. On Friday, the bench submission by the extra Advocate General of the UP government that they need no objection to the transfer of the case to competent jurisdiction in Delhi.

Senior advocate Vrinda Grover, appearing for the petitioner, submitted for her counsel before the court, "My cross examination goes to commence on September 13. this can be the foremost sensitive stage within the trial against his son (the complainant father of the accused) and suddenly these warrants are bobbing up."

"I am living with CRPF protection, my mother's siblings are here. There’s a judicial finding within the sentencing order where words utilized by the tribunal are that she cannot dream of returning to Unnao," the survivor said through her lawyer.

The bench said, "There appears to be, earlier case was transferred from that case, there must be reasons, that reasons haven't evaporated. There’s a death within the family, there are reasons that weighed, there are apprehensions. we've got to think about that. we will transfer it to Karkardooma Court or the other court you wish.

The case was then transferred to Saket court.

The survivor was allegedly gang-raped by some men, including now expelled BJP MLA Kuldeep Singh Sengar, in 2017 when she was a minor. Sengar was sentenced to immurement by a Delhi court in December 2019 on charges of kidnapping and raping the girl.
