Supreme Court Collegium recommends the appointment of two additional judges of the Gauhati HC as permanent judges

On Friday (May 17, 2024), the Supreme Court (SC) Collegium recommended the appointment of two Additional Judges Justice Susmita Phukan Khaund and Justice Mitali Thakuria of the Gauhati High Court as permanent judges. The resolution was passed by Chief Justice of India (CJI) DY Chandrachud, Justice Sanjiv Khanna, and Justice BR Gavai on May 17, 2024. The Collegium of the Gauhati HC unanimously made a recommendation for the appointment of the Additional Judges, aforementioned, as permanent judges. In the resolution, the bench noted that a Committee of two Judges of the SC constituted by the CJI in terms of the Resolution dated 26 October 2017, of the SC Collegium assessed the judgments of the above-named Additional Judges. The Committed reported, “We find that the judgments authored by Smt. Justice Susmita Phukan Khaund and Smt. Justice Mitali Thakuria are well-reasoned, contain an analysis of the facts of the cases and are backed by appropriate case laws. We, therefore, agree with the proposal made by the Collegium of the Gauhati High Court and are of the opinion that both the abovenamed Judges deserve to be considered for appointment as the Permanent Judges.” 

The SC Collegium, in its resolution, said “With a view to assess the merit and suitability of the above Additional Judges for appointment as permanent judges, we have scrutinized the material placed on record including the opinion of the consultee-judges and the report of the Judgment Evaluation Committee. Bearing in mind the above, the Collegium is of the view that (i) Smt. Justice Susmita Phukan Khaund, and (ii) Smt. Justice Mitali Thakuria, Additional Judges are fit and suitable for being appointed as permanent Judges.” The SC Collegium concluded by stating that it resolves to recommend Additional Judges Justice Susmita Phukan Khaund and Justice Mitali Thakuria to be appointed as permanent judges of the Gauhati HC against the existing vacancies.
