In a significant development in an appeal filed by the CBI (Central Bureau of Investigation) against the Jammu Trial Court order to physically produce Kashmiri Separatist Yasin Malik in the proceedings related to the killing of 4 Indian Air Force personnel in 1989, the CBI filed an application in the top court seeking the transfer of the trial case from Jammu Court to Tihar Jail, Delhi. The bench of Justice Abhay S Oka and Justice Augustine George Masih was hearing the matter today (November 28, 2024).
Solicitor General Tushar Mehta informed the Supreme Court (SC) that there is no need to physically produce Yasin Malik before the Jammu Court for trial as the Tihar Jail has a functional court with video-conferencing facilities. He also informed the bench regarding the filed transfer application and another application that sought to amend the petition and cause title to add other co-accused as parties. He said, “I have filed applications for amending the cause title. Placed on record the fact that there already exists a fully functional court in the jail with all the facilities of video conferencing also if needed. And in the past proceedings have taken place in that.”
Earlier on November 21, the SC bench suggested setting up a court in Delhi’s Tihar jail to physically cross-examine terror convict Yasin Malik in Kidnapping and murder cases pending trial before a Jammu court. After hearing the matter today, the SC amended the amendment application. Further, it issued notice to the accused added as additional respondents and on the transfer application filed by the CBI. The SC bench listed the matter for further hearing on December 18, 2024 (Wednesday).
