Sanction to prosecute Yogi: Supreme Court junks plea

The Supreme Court on Friday dismissed a petition challenging the refusal of the UP government to sanction prosecution of CM Yogi Adityanath for his alleged hate speech as an MP in November 2007, which purportedly resulted in communal riots in Gorakhpur.

A bench of CJI NV Ramana and Justices Hima Kohli and CT Ravikumar dismissed the plea filed by one Parvez Parwaz who had alleged that the sanction, pending with the government for nearly two years, was refused within two months of Yogi taking oath as CM. 

Writing the judgment, Justice Ravikumar said, “It appears from the record that the forensic report of the CD, which forms the basis of the prosecution, was found to be tampered and edited as per the October 13, 2014 CFSL report, which position has not been disputed by the appellants.”
