Vijay Madanlal Judgment Review Petitions: Supreme Court Adjourns Hearing To November 27

Today (October 17, 2024), the Supreme Court (SC) of India adjourned the review petitions filed against the Vijay Madanlal Choudhary judgment to November 27, after the parties' request. This order was passed by Justice Surya Kant, Justice Ujjal Bhuyan, and Justice CT Ravikumar. The Vijay Madanlal Choudhary judgment upheld various provisions of the Prevention of Money Laundering Act (PMLA). Earlier on September 18, 2024, the Supreme Court adjourned the hearing to October 03. On July 27, 2022, the judgment under consideration was passed by the top court upholding certain provisions of the PMLA such as,

• “Sections 5, 8(4), 15, 17, and 19 of PMLA, relating to the Enforcement Directorate's (ED’s) power of arrest, attachment, search and seizure;
• Section 24 of PMLA, relating to reverse burden of proof;
• Section 45 of PMLA, provides "twin conditions" for bail (in this regard, it was said that the Parliament was competent to amend the provision in 2018 even after the SC's judgment in Nikesh Tarachand Shah, which struck down the conditions).”

Earlier on July 22, 2024, the SC posted the matter for hearing on August 05, 2024, since then the review petitions have been getting adjourned.
